Debt collection concerns in New Mexico

Calls, messages and collection letters can raise different questions from whether a balance is owed. Preserve both the account information and the communications.

Record dates, caller names, the company identified and the channel used. Keep original letters and messages. Note whether the collector contacted someone else, disputed your identity, or referred to a lawsuit. Avoid sending recordings or private documents until a secure review channel is arranged.
Identify who is contacting you
An original creditor, collection agency, debt buyer and law firm may have different roles. Ask an attorney which rules apply to the conduct and obligation involved. Consumer protections should not be assumed to apply identically to every commercial debt.
Tell the office your concern
When you call, describe the collection concern and identify the company names. Ask how to provide detailed events and supporting records after conflict screening. A conduct complaint and a pending collection case may require separate attention; mention court papers at the outset.
